What is a Mechanics Lien and What Does It Mean To Me?

If you have contractors and subcontractors doing work on your property, you may find yourself dealing with a mechanics lien. Also known as a “property lien” or a “construction lien,” a mechanics lien is a legal claim made against your property which seeks to compensate individuals for their work and materials supplied for your project. 

Before an individual can file a lien against your property, he or she must provide you with what is known as a “Preliminary Notice.” The purpose of this notice is to advise a property owner that the contractor has the right to place a lien against your property if he or she is not paid. These notices can be sent up to 20 days after a subcontractor begins working on your property or after a supplier provides material for your project.

Why Would Someone File a Mechanics Lien?

A contractor, subcontractor, supplier or laborer who was involved with the improvement of your property, for instance adding or remodeling a pool, may file a mechanics lien against you. This gives them the opportunity to take you to court and sue you for what they believe you owe. If the court finds that the lien is valid, homeowners can be forced to pay double the amount owing. In some instances, the court may order you to sell your home in order to satisfy the lien.

What if the Contractor Is at Fault?

A homeowner may still find themselves dealing with a potential mechanics lien if a general contractor does not pay his or her subcontractors and suppliers. Subcontractors and suppliers have the right to file a lien directly onto any property owned by you and which they are providing services or materials. The goal is usually for the homeowner to then put pressure on the general contractor to pay his or her subcontractors or suppliers.

What Items Can be Included In a Lien?

What can and cannot be included in the amount of a lien will vary from state to state. Some costs which can typically be included in a mechanics lien include:

  • Labor costs (i.e. hourly fee)
  • Cost of materials (i.e. concrete, rebar, tiling.)
  • Cost of services  (cost of renting equipment to complete the job)

Items which typically cannot be included in the lien amount include:

  • Attorney’s fees
  • Punitive damages
  • Emotional distress

Any items which do not benefit the value of the property most often cannot be included in a mechanics lien.

How Can I Protect Myself Once Given a Preliminary Notice?

If you have been served with a Preliminary Notice, there are a few steps you, as a homeowner, can take to protect yourself:

  1. Know who’s working on your property.

The first step to take is to request a list of all of the subcontractors and suppliers of materials that will be working on your project. Ask your contractor when the subcontractors will be starting work and when goods or materials will be received.  

  1. Use joint checks.

Paying with a joint check is a great way to prove that you are paying everyone who is working on or providing materials for your project. The next time your contractor asks you to pay a subcontractor or supplier who has provided you with a Preliminary Notice, write a joint check made out to both the contractor and the subcontractor/material supplier.

  1. Consider seeking legal advice.

Because local laws surrounding mechanics liens vary from county to county, it is a good idea to seek advice from a local lawyer who practices construction law.

How Can a Pool Remodel affect your Pool Lighting?

Pool Lighting at NightAt the end of a pool remodel, pool owners expect their pool to perform better than ever. One area which may be negatively impacted by a pool remodel, however, is your pool lighting.

Pool lighting has become standard for today’s pools, as they are an integral part of a pool’s design and operation. But before any pool remodels can begin, the lights of a pool have to be pulled from the side of the pool or spa. These lights are then placed on the deck where they are exposed to weather conditions.

Here’s the problem though: Pool lights are not meant to be outside of the water. Once your pool lights are secured and the pool is filled, your lights are intended to stay underwater for the rest of their days. Exposed components such as the rubber gaskets, once wet, will become brittle and crack when they dry out. When this happens, the chance of your pool leaking at that site increases, and more than that, you may be voiding the manufacturer’s warranty for the lights. So the question becomes is it best to replace your pool lights during the pool remodeling process? 

Pool Lights Aren’t the Only Issue

Another issue involves your light’s power line. Small cracks can cause the power line to the back of the light can become soaked over time. While this itself isn’t always an issue, if the line dries out during the remodeling process, it can crack once the pool is refilled.

 The last consideration is the 3/4″ or 1″ PVC pipe beneath your decking which holds the light cord. Over time this PVC pipe can crack, and it may fill with water or dirt, making pulling a new cord for new lighting difficult (if not impossible) for a pool remodeler or light technician.

Replacing Pool Lighting a Smart Investment During a Los Angeles Pool Remodel

Far too often pool owners elect to refinish the pool, add fun features and install a brand new deck – but they choose not to update the lighting. To their dismay, after the remodel is complete, they find that one or more lights aren’t functional or, worse yet, the pool has suddenly sprung a leak.

The solution isn’t an easy one as a new light can’t be pulled. The only option a pool remodeler or technician has is to cut into the brand new deck and either re-install a new pipe or repair a bad section. The deck can be patched, but it won’t look nearly as beautiful as it did immediately after your outdoor living remodel.

Another important consideration is cost. Swapping out pool lighting during a pool remodel is much less expensive than reopening the pool deck after the remodel. 

Pool lighting has also become far more efficient and affordable for pool owners over recent years. In the long run pool owners can save on energy costs by switching to modern state-of-the-art LED bulbs.

What Causes Rust Stains in Pools and How Can They Be Remedied?

Over time, pool owners may encounter a number of curiously colored stains on the surface of their pool. Some of the most commonly colored stains they’ll notice are dark red and rusty brown, which while alarming at first, may not necessarily indicate that something is seriously wrong with your pool. But how do you know when the pool rust stains are cause for concern?

The Most Common Cause of Pool Staining

There are a number of reasons why you’ll see staining throughout your pool. Below are just a few of the most common reasons why you may be noticing rust stains in pools. 

  • Organic Materials

Organic decaying debris like leaves, twigs, pine cones and acorns sitting on the surface of the pool can result in rust-colored stains. Typically these materials will leave an impression which resembles the shape of the stain-producing product (such as the outline of a leaf).

  • Metal Objects

Anything from bobby pins to toy cars to nails can cause rust to appear in your pool. These objects should be removed as soon as they are discovered. This is particularly true if you have very acidic pool water, as the more acidic your pool, the greater the problem you’ll have.

  • Metal in the Water

Also known as the oxidation of water, if you are regularly seeing small rusty spots in your pool it may be because your water contains small metal fragments. Iron in your pool water is especially problematic, and it can quickly lead to costly repairs.

  • Rebar Stains

Rebar is the metal shafts found beneath the plaster of your pool. Left untreated, the rebar will eventually cause the shell of your pool to crack. This will expose more rebar which will lead to further corrosion until your swimming pool is no longer structurally sound.

Rebar stains are often the result of there not being enough coverage provided around the reinforcements. When rebar is not set deep enough in concrete (something that is common around curved pool walls, benches, steps, and tight corners), it is more susceptible to damage.

Improper drainage is a known contributor (there should be a minimum of 3 inches between the earth and rebar), and tie wire has also been known to cause the rebar to rust. This is because after the soft wire disintegrates, a small hole where water can seep in is left in the plaster and shotcrete.

Finally, the cause of the stains may simply be that improper rebar work was done during the pool construction process.

How to Test Your Rusty Pool Stains

Before taking any action, it’s important to know what you’re dealing with. The easiest way to test the stain is to take some sandpaper and rub the area. If the stain disappears, then you know you don’t have a serious issue on your hands. If the stain continues to increase in size, severity or intensity, then it’s likely that the stain is coming from below the surface of your pool.

Another way to test for stains is to use other items you may already have at home. For suspected iron-causing stains, take a vitamin C tablet and hold it against the stain for approximately 30 seconds. If the stain lightens or disappears, it’s likely that iron is staining your pool. For decomposing organic debris, hold a trichlor tablet on the stain for 30 seconds. If the stain lightens, decaying organic material is likely the issue.

Pool supply stores also carry pool stain ID kits. These kits lead pool owners through a simple series of steps to determine what is causing the rusty stains in their pool.

Dealing with Different Rust Colored Pool Stains

Different approaches will need to be taken depending on what’s causing the stains in your pool.

  • For Organic Material

If the area is small, scrubbing the area and then vacuuming the pool should take care of the stains. Shocking the pool is also a great way to increase the free chlorine in your pool which will remove the rusty brown tannin stains.

  • For Metal Objects

Once the metal object has been identified and removed, brushing the spot with a steel brush or using a rust removing liquid will remove the stain.

  • For Metal in the Water

Some people opt to use magnets to gather the tiny bits of metal. But the easiest way to treat this issue is to use a metal removal additive that will filter out any excess metals. Sweeping and vacuuming your pool more often will also help reduce the effects of metal in your pool water.

  • For Rebar Stains

If you suspect your rust-colored pool stains are due to your pool’s rebar, the time to take action is now. Being extremely corrosive, the structural integrity of your pool has already been put at risk the moment you notice these stains.

The rebar may be fixed with there being water in the pool or with the pool being drained. Typically the more significant the problem, the more likely the pool remodeler will choose to do the job dry.

Your pool remodeler will start by chipping out the affected plaster with a chisel and hammer. Then, using a jackhammer, they will dig deeper into the gunite so the oxidized rebar is exposed.

Reputable pool remodeling companies will then follow the rust by chipping along the vertical and horizontal length of the rebar to determine how far the damage has gone. Once they reach clean steel on all ends, the affected rebar, as well as a few inches of unspoiled steel, is cut out using tools like die grinders, cutoff wheels, bolt cutters, and hacksaw blades. This is done to ensure that no rust is left behind.

Depending on the discussion a pool owner has with his or her pool remodeler, the pool rebar may or may not be replaced before it is patched. The patch then bonds with the concrete. The patch color may not always match the pool, in which case a pool owner may want to consider refinishing the pool.

What is Rebound and How Can It Be Repaired?

Pool Rebound

One of the surprise issues that can arise when remodeling a pool is rebound. Rebound is not something that can typically be seen until after the pool finish has been chipped away in preparation for a new finish, therefore, it is a surprise additional cost for the pool owner. Rebound must be remedied prior to applying the new finish. Otherwise, no remodeler will warranty the finish for cracks or delamination.

What Is Rebound?

Gunite was used for many years to build the shell of a pool. Gunite was not troweled onto the pool like a cement sidewalk is poured and troweled. Instead, the dry material of gunite was mixed at the truck, water added at the nozzle to it as it is sprayed by the operator at the pool, shot from a large hose connected to a high-powered compressor onto the walls and floor of the pool, forcing it to condense into a high-density material, with the goal of a minimum of 2,500 PSI (Pounds per Square Inch). Rebound is the material that “bounces” off or shaves off during the application and sculpting process.

Think of it this way — if you were to make a mudball mixed of dirt, sand, and water and throw it on a wall, some of the material would splash in all directions. Probably the more watery outer portion, while the denser, more stable center of the mudball would stick where you threw it. The same thing with gunite; the rebound portion has more sand than cement and, therefore, is not very strong or stable.

A good pool contractor will not use the rebound material. It is less dense, less strong and no longer being shot under high pressure and will not cure nearly as hard as the gunite that was properly placed. The rebound should be discarded. However, to save costs, some gunite crews would use the rebound to create steps, benches or to fill in corners. This will lead to weak spots in the pool finish that can delaminate or crack once the pool finish is applied.

Today, by far, many pool builders no longer use gunite to build pool shells for this very reason. Instead, they use Shotcrete which is a pre-mixed material, as opposed to being mixed on-site, and already has the high PSI that a pool shell requires. It still, however, needs to be shot at a high-pressure velocity in order to condense. As time goes on, remodelers should see less and less rebound as they will be working with pools that were built with Shotcrete instead of gunite.

How to Deal With Rebound Cracks

Most pool owners are completely unaware that rebound has been used in the construction of their pool or spa as it takes time for the cracks to appear. Alternatively, cracks may never appear and the rebound issue is not obvious until the finish has been removed. Even though the pool finish may not have cracked since the pool was built, there is no guarantee that the newly applied finish won’t crack. These must be repaired in order for the new finish to be structurally sound.

While small cracks caused by small areas may be repaired and patched, most situations require a remodel of the entire pool or spa.

 Gardner repairs rebound by charging a minimal charge per wheelbarrow of material since we understand that this is a surprise cost to the pool owner. This is not an area of profit for Gardner so much as a service to fix an issue that needs to be addressed.

 Of course, there are many other benefits from pool resurfacing apart from eliminating the rebound cracks in your pool:

  • Easier to balance your pool water chemistry
  • Reduces the opportunity for algae to attach to a rough surface and grow

Top 5 Pool Renovations of 2019

You know the phrase, “Nothing lasts forever?” Well, while the actual pool itself may last for a very long time, the components don’t. After 10 years or so, for example, a pool plaster finish will begin to visibly show wear and tear. Remember that from the moment a pool is filled with water and chemicals and exposed to sun and weather, there is a silent battle happening beneath the placid waters. In addition to the pool finish, though, there are many popular reasons for remodeling your pool and spa. We’re already halfway through 2019, so let’s take a look at the top pool renovations we at Gardner Outdoor and Pool Remodeling have had the pleasure of helping our Southern California clients throughout the year.

1. Pool Plumbing and Equipment

This may not seem to be as exciting as the other pool renovation projects on this list, but do you know what is exciting?

Saving money.

What may surprise many homeowners is that the second piece of home equipment that uses the most energy is the pool pump – right after the home air conditioner. Fortunately, the pool industry has been one of the leaders in R&D to discover new designs that save energy and, therefore, money. For example, a variable-speed pool pump, when replacing a 3 HP single-speed pump to run pool water circulation, will save 90% in energy costs. Cost savings can also be enjoyed is more energy and gas-efficient pool heaters, too. If you plan to be in the home for more than 2 years, these types of investments will typically pay for themselves.

2. Automation

The #1 add-on to pool renovations is definitely equipment automation. The concept of the smart home has extended to the backyard.   • Deck Jets – if you are changing your deck, that may be the time to consider installing deck jets that add a touch of beauty and whimsy to your pool design. Let’s face it – who doesn’t want a mini-Bellagio in the backyard?
  • Sheer descents – just a fancy name for a waterfall into your pool. Just be careful – you need an expert to guide you on how many and how high you may want to install waterfalls. You might be surprised at how loud falling water can be. You don’t want to drown out your guests’ conversations with a waterfall that is overwhelming.
  • Fountains – a beautifully designed waterfall can become a focal point for the backyard, especially if lit properly.

4. Pool Tiling and Mosaics

A relatively inexpensive way to update your pool is to change your waterline pool tile. This can immediately give your pool a more contemporary feel. Pool finishes that are in good shape can easily be saved during this construction process.

5. Pool Replastering

Let’s not forget the most basic pool renovation of all; pool replastering. There are many more choices today than even 20 years ago. Colors, textures, longevity, durability, and sheer beauty are only a few of the considerations when reviewing your options.

Be aware of the tell-tale signs that mean it may be time to replaster your pool and spa:

  • The finish is wearing down and your pool’s gunite (cement shell) is beginning to show through
  • Mineral stains (such as iron and copper) are destroying the appearance of your pool. While this may be able to be remedied with chemical cleaning, sometimes the only solution is a complete replaster.
  • Leaks through cracks in your finish. Don’t be fooled by your auto-fill. It may hide the fact that you have a leak. Try turning the auto-fill off once every 6 months and check your water levels.
  • The interior of your pool is rough and uncomfortable as the finish begins to decay

The least expensive finish available is the basic Plaster Finish. While this may be the most affordable, it may not always be the best investment. Due to its soft mineral finish of crushed marble, plaster will only last 8 to 10 years in a residential pool; even less in a commercial pool. It’s important to consider your investment versus the longevity of the product. If you plan to be in your home for more than 10 years, it may be beneficial to consider alternative pool finishes, such as aggregate finishes. A Pebble Sheen finish, for example, while costing much more at the time of the investment, will last an average of 25 years and, actually, cost much less compared to replastering 2 or 3 times in that same period.

10 Summertime Water Safety Tips

 

The pool can be one of your family’s favorite places and the perfect summertime spot for fun and bonding. While pools are a fantastic way to escape the Southern California heat and enjoy sunny days together, it’s always important to keep safety in mind.

 

At Gardner Outdoor and Pool Remodeling, we love the water and encourage everyone to spend as much time as possible in it, but we also want to make sure people follow smart water safety tips.

 

Here are 10 of the most important water safety tips to keep in mind.

 

  • While children are in the pool they need your undivided attention. Never, ever leave children alone in the pool at any age.
  • The American Academy of Pediatrics recommends that an adult who knows how to administer CPR should actively supervise children at all times.
  • Children under the age of five should never be more than an arm’s length away from the supervising adult at all times.
  • Keep rescue equipment accessible at all times.
  • Especially when younger children are present, put up a fence creating a barrier between your home and your pool so children can’t get into the pool area without your knowledge.
  • After using the pool, remove any pool toys from in and around the pool to avoid the temptation to get in the water.
  • Always designate one adult to be the “Water Watcher.” That way there’s no confusion about who’s watching the children. Switch the designated adult as necessary.
  • When children are getting too rowdy, calmly remove them from the pool and explain the dangers to them. Don’t let them return to the pool until they have calmed down.
  • Don’t confuse air-filled swimming aids, like water wings or puddle jumpers, with life jackets. They are not the same thing.
  • Finally, never make assumptions. Just because your child knows how to swim does not mean that he or she is always safe in the water and no longer needs supervision.

Pool School: How Often Should a Pool Pump Run in the Summer?

During the summertime when your pool’s in high use, the amount of time you run your swimming pool filters and pumps should be increased. But how much time is the right amount of time when it comes cleaning a busy a pool and keeping it clean?

 

Why You Need Your Pump

Running your pump on a regular basis is just part of regular Southern California pool maintenance. The pump is the heart of your pool’s circulation system, clearing out debris and keeping the chemicals properly mixed so that the pool water remains sanitary. How often you run your swimming pool filters and pumps will depend on a variety of factors, such as:

  • The size of the pool
  • How often the pool is being used
  • How much debris your pool collects/if the pool is regularly covered

Calculating Your Pump’s Running Time

This calculation can be used as a general guide for determining how long you should run your pump for proper pool maintenance:

(Pool volume/filtration rate) x 2 = Hours necessary to run a filter

So let’s say you have a 20,000 gallon pool and a filtration rate of 3000 gallons per hour. Your equation would look like this:

(20,000/3000) x 2 = 13.333 or 13 hours and 20 minutes during a 24 hour period of time

 

Other Factors to Consider

Again, this equation is intended to give you a general idea of how to clean a pool and keep it clean during the summer months. The size and type of pump that you have can also play a large role in how long you run your pump (as well as your operating costs). Having a smaller, high-efficiency pump may allow you to run the pump for anywhere from a third to half the amount of time of that of a larger and older pump. Keep an eye on your water and remember to test it frequently to ensure that the water stays clean and healthy.
